TERMS AND CONDITIONS OF THE YUTRA.EU ONLINE STORE

I. GENERAL INFORMATION

  1. What do these Terms and Conditions regulate?

These Terms and Conditions specify the rules for providing electronic services and selling goods and services by Salag Sp. z o.o. via the online store available at: https://www.yutra.eu/.

These Terms and Conditions apply to both Consumers and Non-Consumer Customers who use the online store to access electronic services and conclude Sales Agreements.

If any provision of these Terms and Conditions or contracts related to the operation of the online store is less favorable to the Consumer than the provisions of the Consumer Rights Act of 30 May 2014 (consolidated text: Journal of Laws of 2023, item 2759), such provision is invalid, and the relevant consumer protection law applies instead. In case of any unintentional inconsistency between these Terms and Conditions and the aforementioned Act, the latter shall prevail.

  1. Definitions

a) Customer – a natural person, legal entity, or an organizational unit without legal personality that is granted legal capacity by law and uses electronic services or has concluded or intends to conclude a Sales Agreement with Salag.

b) Consumer – a natural person concluding a legal transaction with Salag that is not directly related to their business or professional activity. The provisions regarding Consumers also apply to individuals entering into an agreement directly related to their business activity if it is evident that the agreement is not of a professional nature for them.

c) Terms and Conditions – this document regulating the principles of electronic service provision and the sale of goods and services via the online store.

d) Online Store – the store available at: https://www.yutra.eu/.

e) Salag – Salag Sp. z o.o., headquartered in Suwałki, ul. Szafirowa 5, 16-400 Suwałki, Poland, registered in the National Court Register (KRS) under number 0000992485, VAT: PL8441941084, REGON: 790744763, with a share capital of EUR 1,000,000, providing electronic services and selling goods and services via the Online Store.

f) Sales Agreement – an agreement concluded between Salag and the Customer via the Online Store for the sale of goods or services.

g) Consumer Rights Act – the Act of 30 May 2014 on consumer rights (consolidated text: Journal of Laws of 2023, item 2759).

  1. Availability and Acceptance of the Terms and Conditions

These Terms and Conditions are available free of charge on the website https://yutra.eu/terms-and-conditions. Customers can review, download, and print them at any time.

Acceptance of the Terms and Conditions is voluntary but necessary for using the electronic services and purchasing goods or services via the Online Store.

II. ELECTRONIC SERVICES PROVIDED BY THE ONLINE STORE

  1. Technical Requirements

To use the Online Store, the Customer must have a device (computer, tablet, smartphone, or another Internet-enabled device) with a web browser such as Google Chrome, Mozilla Firefox, Opera, or Safari with cookies enabled. The Customer must also have a valid and active email address.

  1. Rules for Using the Online Store

The Customer is required to use the Online Store in accordance with the law, these Terms and Conditions, and good practices, respecting the personal rights and intellectual property of Salag and third parties. The Customer is particularly obliged to:

  • Provide only truthful, up-to-date, and complete data.
  • Update their data as necessary.
  • Use the Online Store in a manner that does not interfere with its operation or the use of the Online Store by other Customers.
  • Pay the full price in a timely manner.
  • Collect the ordered products as per the selected delivery method.

Posting unlawful content is prohibited.

  1. Electronic Services Provided by the Online Store

Salag provides the following electronic services free of charge via the Online Store:

  • Account Services
  • Shopping Cart Services
  • Order Placement and Sales Agreements
  • Newsletter Services
  • Viewing content within the Online Store
  1. Account Registration and Usage

Registering an account is optional. Customers can place orders without creating an account.

To register an account, the Customer must:

  • Go to https://www.yutra.eu/
  • Click "LOG IN" and fill out the registration form under "DON’T HAVE AN ACCOUNT?"
  • Provide a valid email address, set a password, and enter personal details (name, address, and phone number).
  • Accept the Terms and Conditions and Privacy Policy.
  • Click "REGISTER" to complete the process.
  1. Shopping Cart

The Shopping Cart allows Customers to add products or services for ordering and apply discount codes. The cart's contents are saved even after the browser session ends.

  1. Newsletter

Customers can subscribe to the Newsletter to receive promotional and product updates. They may unsubscribe at any time by emailing [email protected].

  1. Order Placement and Payment

Customers can place orders online 24/7. Orders placed on weekends or holidays are processed on the next business day.

Orders must be paid within 7 days; otherwise, they will be canceled.

  1. Delivery and Shipping

Salag delivers orders across the European Union. Delivery times vary depending on the destination country. Estimated delivery times are displayed at checkout.

Delivery costs depend on the destination and order value and are displayed during order placement.

Customers must inspect the package upon delivery. If it appears damaged, they should refuse receipt and notify Salag immediately at [email protected].

III. RETURNS AND WARRANTY

  1. Right of Withdrawal

Consumers may withdraw from a Sales Agreement within 14 days of receiving the goods without providing a reason. The withdrawal request must be sent to [email protected]. The Customer must return the goods at their expense to the following address: Salag Sp. z o.o., ul. Szafirowa 5, 16-400 Suwałki, Poland.

  1. Complaints and Warranty

Customers can submit complaints regarding defective goods via email at [email protected]. Salag will respond within 14 days.

IV. FINAL PROVISIONS

These Terms and Conditions are effective as of January 1, 2024.

All contracts concluded by Salag in connection with the operation of the Online Store are governed by Polish law. Any disputes will be settled by the competent Polish courts.
